Seat Belt Check Leads to Drunken Driving Charge

A cop checking drivers for seat belts arrested an Orland Park man after he refused to take any tests during a drunken driving stop.

Casey J. Banks, 30, of the 15100 block of Card Court, Orland Park, was charged with drunken driving and failing to wear a seat belt, according to a Tinley Park police report.

A Tinley Park cop was working a seat belt detail on Nov. 26 near the intersection of 159th Street and 84th Avenue when, at about 12:20 a.m., when Jeep drove by, the report states. The driver, Banks, was not wearing a seat belt and, after turning his head, reached for the belt.

Police pulled the Jeep over and spoke with the driver, the report states. The cop could smell a strong odor of alcohol coming from inside and on his breath.

The officer asked Banks questions but was unable to decipher his mumbled responses, the report states. He claimed he hadn't been drinking and didn't responded to more questions asked by police. Casey also refused to take any tests, saying he wanted an attorney even though he hadn't yet been arrested.

Police took Banks into custody and drove him to the police department for booking, the report states. He refused to take a breath test and initially was uncooperative with police during processing.
