Tinley Man Pleads Guilty to Sexual Abuse in Mokena Park

David J. Potter, 20, of the 17800 block of 66th Court in Tinley Park, pleaded guilty Wednesday to one count of aggravated criminal sexual abuse, receiving probation and mandatory registry as a sex offender.

A man has been sentenced to two years probation for having sex with a 13-year-old girl.

David J. Potter, 20, of the 17800 block of 66th Court in Tinley Park, agreed to register as a sex offender as part of a plea deal offered by the state. He  just as pretrial hearings were set to begin Wednesday.

Potter had consensual sex with the girl in a Mokena park after they met this summer at a Tinley Park roller rink. The girl’s parents reportedly contacted police once they learned of the incident.

For the rest of his life, Potter will have to register with his local police department as a sex offender. If he fails to, the state can bring separate felony charges against him.

Had he gone to trial and lost, Potter was facing a maximum penalty of three to seven years behind bars. His criminal record in Will County is clean.

Following sentencing, the girl’s father said he preferred this outcome to putting his daughter on the stand to testify.

“I’m just glad this whole thing is over,” he said, leaving the courthouse.

Potter remained in jail Wednesday morning on a $150,000 bond, but would later be released. Between hearings in Judge Daniel J. Rozak’s courtroom, a police officer involved in the case asked Potter how he had been holding up.

“The food sucks,” he replied, looking perturbed but smiling.

A sheriff’s deputy leaned in and said, “It’s jail, kid, not kindergarten.”

O WOW!! i'm ALMOST SURE people are going to have something mean or ignorant or condescending but that's ok im all up for it and curious! MY personal opinion i think that regardless if a girl is under age or not, I believe that if she is old enough to speak and old enough to know what having sex is, then it is my personal opinion that she should be able to

choose for herself if she DOES or DOESN'T want to have sex with a boy regardless if he is legally considered an adult or not. If she can physically tell him and show him that YES she DOES INDEED want to have sex equally as he chooses to with her, then why should the guy be punished alone. If the minor can tell the courts that she did consent to having sex with him, then i believe it was 50/50. adults ARE suppost to have more mature judgement then a minor child does, but i remember what i was like at the age 13 and i can firmly tell you as i sit here and type this right now that i know for sure positivley absolutley that when i was a 13 yr old girl i was WELL capible and more then willing to make the choice to have relations with an older boy. I don't think its fair that he should get punished for something that he did not act alone on. Lets just hope that she was honest and told her parents that she DID in-fact consent to have sex with him and didn't lie and place all the blame on the boy. shout out to the dad of the minor that is more worried about his daughter having emotional problems post trial & not being more concerned about the boy getting punished and going to jail. At least he sees his daughter DID play a part in the case that is CLOSE to equal amount as the young man did! Happy he didn't go to prison. Sucks gota register forever now but i guess ya win some n ya loose some. Let's send the rapist's & child molestors to prison n not 2ppl that AGREE to have sex together
