Attorney: Throw Out Arrest of Victim Nabbed on Weapons Charge During Ashford House Brawl

The public defender for Francis Gilroy Jr., who was arrested for unlawful weapons possession during the last May's Ashford House brawl, filed a motion Tuesday to suppress the arrest.

The arrest of man who was charged with unlawful possession of weapons by a felon during the Ashford House brawl could be tossed out if a Cook County judge rules in favor of a motion by his public defender. Francis John Gilroy Jr., 65, of West Palm Beach, Fla., was reportedly one of the targets during the incident, where five Indiana men were charged in connection with the attack on a suspected white supremacist group. Those men—labled the Tinley Park or Ashford House 5—are in talks for a plea deal. Ashford House 5 Lawyers Call Arrest 'Invalid'

Lawyers representing the five men accused of attacking a group of alleged white supremacists in May motioned Tuesday to suppress evidence gathered in the traffic stop that led to their arrest.

Attorneys representing five men who were accused in May of an attack at a Tinley Park restaurant said Tuesday morning that they believe the traffic stop leading to the group's arrest was illegal. They filed a motion shortly after 11 a.m. to suppress evidence gathered during that stop, in which Indiana men John Tucker, 26; Cody Sutherlin, 23; Dylan Sutherlin, 20; Alex Stuck, 22; and Jason Sutherlin, 33; were arrested.
