An attorney representing the Tinley Park Police Department's K-9 handler is confident the court will not dismiss his client's lawsuit. The Village of Tinley Park has filed—and renewed—a motion to dismiss the litigation brought against the village Sept. 23 by officer Bob Diorio. His attorney, David Stevens, said he will respond to the motion this coming Monday, Jan. 30. "The motion filed by the village is challenging the legal merit of this case," Stevens said Wednesday. "We're confident that we are going to defeat their motion to dismiss and at that moment, we can move forward with this case." The village has more than three weeks left to respond to the lawsuit, which was officially presented to them about 10 days ago, officials said.
The village has until Nov. 28 to respond to a lawsuit filed in September by a Tinley Park police officer and K-9 handler, officials said this week. “It’s just the initial answer to our complaint that’s due then,” said the officer’s attorney, David E. Stevens. “It could be a court pleading, it could be a motion to dismiss.
